Wesley R. (“Wes”) Powell is a partner in the Litigation Department and serves as the Co-Chair of both Willkie’s Antitrust and Competition and Pro Bono Practice Groups. Wes advises clients on antitrust issues in the context of mergers and acquisitions and represents clients in merger reviews and enforcement actions by the U.S. Federal Trade Commission, U.S. Department of Justice, and U.S. state antitrust enforcement agencies. He also represents clients in a wide range of non-merger antitrust investigations, class action litigation, and other antitrust disputes. Wes’s antitrust experience spans a range of industries, including asset management, consumer goods, defense, energy, financial services, health care, hospitality, insurance, payment cards, pharmaceuticals, retail, transportation, and technology, among others. He also has represented clients in corporate governance, employment, First Amendment, restructuring, securities, and other general commercial litigation matters.

Wes consistently is recognized as one of the nation’s most active and impactful antitrust lawyers. Chambers USA has ranked him among the leading individuals practicing Antitrust Law in New York for the past 16 years, including in its most recent 2023 edition. He also is recognized as a leading antitrust lawyer and litigator in Best Lawyers (2023), The Legal 500 United States, New York Super Lawyers and Lawdragon 500 Leading Litigators in America (2023). Wes previously served as Chair of the Antitrust Section of the New York State Bar Association, and is an active thought leader in the constantly evolving antitrust landscape nationally and globally.
 
Wes has been a pro bono leader for almost 30 years, having led many impact litigations spanning a wide range of issues and clients, including: First Amendment rights of Asian American anti-sweatshop organizations; habeas corpus rights of “enemy combatants” detained in Guantanamo Bay, Cuba; same-sex marriage; reproductive rights; access to adequate heat and hot water for New York public housing tenants; and access to public health benefits, to name but a few. Wes is perhaps best known for his ground-breaking litigation on behalf of transgender individuals seeking access to medically necessary treatment for gender dysphoria under government-sponsored health plans, in Cruz v. Zucker (access to care under New York Medicaid plan); Lange v. Houston County, Georgia (coverage under county health plan); and Toomey v. Board of Regents (coverage under health plan for Arizona state employees). Most recently, Wes led a Willkie team in challenging the New York Medicaid program’s failure to cover medically-necessary dental care, culminating in an historic class action settlement securing expanded dental coverage to more than five million low-income New Yorkers (Ciaramella v. Zucker). Wes’s work on these transgender healthcare and Medicaid access cases has provided a blueprint for advocates seeking to challenge similar coverage restrictions in other states throughout the United States.

Wes and Willkie’s work on these matters has been widely recognized. Bloomberg Law named a Willkie team led by Wes as a “2023 Pro Bono Innovator” for its success in securing expanded dental coverage in Ciaramella. This statewide victory also earned Wes the “Public Interest Law Leadership Award” as part of The Legal Aid Society’s 2023 Pro Bono Publico awards, and a “Highly Commended” status among finalists for the “Pro Bono Lawyer of the Year” distinction at the 2023 Chambers USA D&I Awards. The New York State Bar Association awarded Wes its 2023 “Outstanding Pro Bono Volunteer Award” in recognition of his leadership in civil rights cases on behalf of the LGBTQ+ community, low-income New Yorkers, asylum-seekers, and others in need over the course of his almost 30-year career.

Wes also is routinely recognized for his leadership in defending LGBTQ+ rights, and is considered among the nation’s leading law firm advocates for the transgender community, particularly for securing healthcare coverage of gender-affirming care and asylum. In 2024, the New York State Bar Association awarded Wes its “2024 LGBTQ+ Vanguard Award,” a recognition bestowed on attorneys who are “members of the LGBTQ+ community or an ally of the community who has constantly and consistently gone above and beyond to support the LGBTQ+ community in New York State and around the country.” He was named among the “Notable 2022 LGBTQ Leaders” by Crain’s New York Business, a series recognizing outstanding LGBTQ professionals across the New York business community who have made significant strides in advancing diversity, equity and inclusion, and was previously named “LGBT+ Equality Lawyer of the Year” at the 2019 Chambers USA D&I Awards. The Transgender Legal Defense and Education Fund recognized Wes and the Firm as its “Pro Bono Partner of the Year” in 2022 for his commitment to pro bono service and leadership in connection with the Firm’s landmark victory in Lange, a first of its kind ruling in the South. Wes also was recognized by The AmLaw Litigation Daily as “Litigator of the Week ‘Runner-Up’” in 2023 for securing the final settlement of the landmark class action Toomey that permanently prohibits the state of Arizona from excluding gender-affirming care from its employee health plan.
