A Willkie team contributed a chapter titled “Creditor Considerations in Cross-Border Chapter 11 Cases: A Latin American Perspective” to The Guide to Restructuring, Sixth Edition, published by Latin Lawyer.
The chapter addresses the increasing use of Chapter 11 of the Bankruptcy Code by Latin American companies to implement complex restructuring transactions. It provides individual creditors in Latin American Chapter 11 cases with practical guidance on how to maximize their recoveries, and an analysis of how non-US legal considerations often shape creditor outcomes in these cases.
The chapter provides an overview of the Chapter 11 process and focuses on six recent cases where Latin American companies successfully used the Chapter 11 process to obtain critical debtor-in-possession financing, negotiate a restructuring of their balance sheets and emerge as reorganized going concerns.
The chapter was co-authored by Brett Miller, U.S. Co-Chair of the Strategic Capital and Restructuring Department, partner Jim Burbage, and associates Marissa Sable and Federico Curbelo.
