Willkie’s IP Litigation Group recently secured a complete victory for Synopsys, defeating a trademark infringement claim brought by Optical Systems Design, LLC (“OSD”). OSD had sought both monetary damages and an injunction that would have barred Synopsys from using its corporate name.

Synopsys filed an action for declaratory judgment of noninfringement in late 2024 in the District Court for the Central District of California, after receiving a series of letters from OSD which threatened suit and demanded either an eight-figure cash payment or that Synopsys either cease all use of its own SYNOPSYS® trademark.  

In the litigation, Willkie prevailed on its motion to dismiss OSD’s counterclaim for trademark infringement, achieving a finding that OSD had unduly delayed bringing its claim against Synopsys. While Synopsys’ motion to dismiss OSD’s amended counterclaim was pending, OSD stipulated to judgment for Synopsys on all of its declaratory judgment claims and to dismissal with prejudice of its own infringement claim. The district court therefore entered judgment in favor of Synopsys and against OSD on January 7, 2026.
