Eric Lohrenz is counsel in Willkie’s IP Litigation Practice Group. He is based in the Firm's Chicago office and focuses his practice on complex intellectual property litigation.  

Eric has extensive experience in intellectual property matters involving complex technologies such as pharmaceuticals, biologics, drug delivery, medical devices, personal diagnostic devices, polymers and polymer end-uses. He has managed all aspects of patent litigation, from pre-litigation investigation and preparation of pleadings through fact and expert discovery, depositions, motion practice, pretrial, Markman hearings, patent trials and appeals. Eric also has experience with international patent proceedings.
 

Experience

Eric was previously an attorney at another major law firm in Chicago. He also was in government service for ten years, including as General Counsel to the Illinois Emergency Management Agency for the duration of the COVID pandemic, and as Director of Administration for the Illinois Board of Admissions to the Bar. In these roles, Eric had regular interactions with the Governor of Illinois and Justices of the Illinois Supreme Court.
 

Eric’s notable representations include: 

  • Representation of patent owner in ANDA litigation in the District of New Jersey related to an anti-epilepsy drug with annual sales over $1 billion. The district court ruled in favor of the client on summary judgment for all issues and the Federal Circuit affirmed.
  • Defended licensing dispute in the Northern District of California involving liposomal drug delivery systems where the plaintiff sought over $2.5 billion in damages. The district court dismissed the case with prejudice and the Ninth Circuit affirmed.
  • Drafted claim construction briefs in inventorship dispute concerning liposomal drug delivery systems, resulting in case-dispositive claim construction in favor of client. 
  • Managed investigation and counseling re potential claim for infringement of Asian patents directed to novel polymers. Participated in selection and oversight of Asian counsel; monitored, drafted and commented on filings in Asian proceedings to ensure consistency with related patent proceedings in other countries.
