Partner Matthew Freimuth has been recognized with a “Shout Out” by The AmLaw Litigation Daily for recently securing a significant victory in a trademark infringement case argued before the U.S. Court of Appeals for the Tenth Circuit. 

 

He led a Willkie team that represented Edwell, Inc., a nonprofit organization formed during the COVID-19 pandemic that provides resources and coaching to primary and secondary school educators to improve their mental health and wellbeing. The appellate court affirmed judgment for Edwell in the case brought by project management company M Welles and Associates, Inc., which alleged that Edwell, Inc. violated federal trademark law by infringing on its trademark “Edwel.” A divided Tenth Circuit panel agreed with the district court in favor of Willkie’s arguments on behalf of Edwell that consumers were unlikely to be confused by the two companies and their product offerings, which operate in different markets.
