Willkie attorneys co-authored an article titled “Unsecured Creditor Perspectives in Energy Restructurings” in Practical Law The Journal, published by Thomson Reuters.
The article provides guidance to unsecured creditors involved in restructurings in the oil, gas, and coal industries, focusing on strategies to maximize distribution outcomes. It discusses the steps unsecured creditors can take to manage risks in fast-paced energy restructurings, including by deriving value from a debtor’s assets, leveraging debtor-in-possession financing, cash collateral arrangements and environmental liabilities, and evaluating the individual creditor groups’ strategies.
