Andrew Spital is a partner in the Litigation Department and Chair of the Employment Litigation & Counseling Practice, where he represents companies and individuals in a variety of complex commercial disputes with a focus on employment and class action litigation. Areas of experience include antidiscrimination laws, wage-and-hour regulations, contractual disputes and HR compliance. Andrew also regularly advises clients on HR issues, internal investigations, overtime compliance and risk mitigation.

Experience

  • EEOC v. Bloomberg (S.D.N.Y.): obtained dismissal of pattern and practice discrimination and retaliation claims brought by the EEOC, and the dismissal of over 75 individual claimants
  • De Oca v. Bloomberg (S.D.N.Y.): represented Bloomberg in a wage-and-hour case involving a class of over 400 individuals
  • Jackson v. Bloomberg (S.D.NY.): represented Bloomberg in a wage-and-hour case involving a class of over 400 individuals
  • Hill v. Bloomberg (S.D.N.Y.): obtained summary judgment on all claims in a single-plaintiff discrimination case
  • Ben-Levy v. Bloomberg (S.D.N.Y.): obtained summary judgment on all claims in a single-plaintiff discrimination case
  • In re Converium Holding AG Securities Litigation (S.D.N.Y.): represented foreign issuer in securities class action arising out of IPO of reinsurance company
  • Adelphia Communications chapter 11 proceeding: represented debtor in trials, contested matters and adversary proceedings, including In re Adelphia (S.D.N.Y.); dismissal of appeal for mootness and judicial estoppel
