Kevin B. Clark is senior counsel in the firm’s Litigation Department. He has thirty-five years of experience serving sophisticated commercial clients across a wide spectrum of complex civil litigation, investigations and hearings. Kevin is known for his ability to organize, manage and advantageously resolve overwhelmingly difficult situations, frequently at the early stages of a matter. When that is not feasible, he quickly and efficiently identifies and develops the key issues, evidence and themes, and then presents a compelling and intelligible case to the relevant audience. He has experience in many areas, including antitrust, bankruptcy, class action, contractual, environmental, insurance, intellectual property, multi-district, multi-jurisdictional, professional liability, reinsurance, RICO, securities, tax and other kinds of business disputes. He represents clients in federal and state court proceedings at both the trial and appellate levels, as well as in arbitrations, mediations, hearings and investigations before federal and state agencies and Congress.

  • Antitrust: representation of numerous clients across a wide spectrum of industries and issues  in private litigation, governmental investigations and litigation, and merger clearance.
  • Bankruptcy: litigation counsel to large cable television carrier, major sporting goods manufacturer and country’s largest furniture retailer in bankruptcy reorganization proceedings involving multi-billion dollar and multi-hundred million dollar disputes over valuation, inter-creditor priorities and other issues.
  • Congressional Investigations: representation of a large accounting firm in Senate Permanent Subcommittee on Investigations and Senate Banking Committee investigations into tax shelters.
  • Insurance: representation of insurers, reinsurers, insurance brokers and policyholders in a range of disputes across the U.S. and in the U.K.
  • Intellectual Property Litigation: trial counsel on antitrust patent abuse defense for multi-national agro-chemical manufacturer in international patent arbitration; trial counsel on trademark infringement issues for international machine tool manufacturer in International Trade Commission Section 337 importation prohibition proceeding; counsel to global electronics and appliance manufacturer on nine figure damages claims in patent infringement suit in Delaware federal court; counsel to multi-national oil company in antitrust trademark tying suit.
  • Mediations and Arbitrations: lead counsel in scores of  mediations and in numerous arbitrations; have also served as mediator in complex civil litigation.
  • Multi-Jurisdictional Litigation: more than a decade of experience coordinating, streamlining and harmonizing large numbers of simultaneous and overlapping lawsuits, arbitrations, governmental investigations and pre-litigation claims arising in multiple jurisdictions and before a variety of tribunals throughout the United States.
  • Securities: defense of numerous companies, directors and officers in a variety of federal and state securities matters.
  • Toxic Tort Litigation: counsel to one of the country’s largest common carriers of chemicals in a toxic tort suit brought by thousands of plaintiffs in Louisiana federal court.
