Milan/Rome partner Maurizio Delfino and associate Pia Sorvillo published an article, entitled “Private Equity Funds and Antitrust Law: An Odd Match” in the first issue of 2003 of Focus Europe, a supplement to The American Lawyer and Corporate Counsel magazine. The article provides an overview of essential antitrust questions raised by investments made by private equity funds in Europe and Italy in particular. It examines the structure of private equity funds and the inadequacy of current antitrust schemes. In their article, Mr. Delfino and Ms. Sorvillo discuss issues arising from the fact that neither the EC Merger Regulation nor the Italian Competition Act provide provisions directly addressing acquisitions by investment funds, which they say creates an “antitrust law vacuum.” Mr. Delfino, Willkie partner in charge of the firm’s Milan and Rome offices, specializes in corporate finance, capital markets and antitrust.
