Mr. Mancino is recognized for his role in a pro bono victory blocking President Trump’s use of an emergency declaration to fund construction of a border wall.

On October 18, The Am Law Litigation Daily named Willkie partner Richard Mancino a “Litigator of the Week” for his successful pro bono work challenging President Trump’s proclamation of a national emergency to fund border wall construction. A Texas federal court ruling issued on October 11 in favor of Willkie’s clients declared that President Trump’s proclamation of a national emergency along the US-Mexico border to fund a border wall violated federal law and is invalid because it illegally sought to override Congress’s decision not to fund further border wall construction.

The Q&A features a discussion of the case with Mancino and co-counsel Mr. Gerson of Epstein Becker & Green and Anton Metlitsky of O’Melveny & Myers. In describing the case’s overarching theme, Mancino noted “Our challenge was not a partisan effort or about political views, but rather a defense of the Constitution and delicate balance between the executive and legislative branches upon which our government is founded.”
