Topic: Many, if not most, of the Chapter 11 bankruptcies in the past few years have been built around a section 363 sale of assets rather than a stand-alone reorganization. Our panel will address issues arising from this trend including (1) what interests may the seller strip; (2) how fast is too fast; (3) who should "pay the freight;" and (4) avoiding post-closing problems.
