The Willkie litigation team received a shout out for defeating a putative securities class action against beauty chain Ulta.

Partner Craig C. Martin, Chairman, Midwest, and his colleagues in Willkie’s Litigation Department have been recognized by The AmLaw Litigation Daily for their recent victory in a putative securities class action against Ulta Beauty Inc. and its top executives. Craig led a litigation team that included partners Amanda Amert and Matt Basil and associate Samantha Glass.

Craig and his team received a shout out in the “Litigator of the Week” series for securing the dismissal of a high-stakes lawsuit alleging that national beauty chain Ulta reshelved returned, used products and resold them as new and that the company’s former Chief Executive Officer and its Chief Financial Officer misled investors about the practice in SEC filings and public statements.

In a 44-page opinion, Judge Martha M. Pacold of the U.S. District Court for the Northern District of Illinois firmly rejected claims the defendants were liable for securities fraud under sections 10(b) and 20(a) of the Exchange Act.
