Miriam A. Bishop is special counsel in the Corporate and Financial Services Department of Willkie Farr & Gallagher llp in Washington. Ms. Bishop provides advice and assistance regarding various international trade laws, including customs, export controls, trade sanctions, and trade remedies. With respect to U.S. customs laws, Ms. Bishop represents clients in pre-audit reviews, internal audits, and Focused Assessments conducted by U.S. Customs. She also evaluates the dutiability of royalties and other payments to foreign suppliers, determines the country-of-origin marking requirements and tariff classification of imported merchandise, handles prior disclosures, duty tenders, and protests, and assists companies in developing compliance programs. Additionally, Ms. Bishop assists companies in qualifying their goods under NAFTA and dealing with GSP, FTZ, and duty drawback programs. With respect to U.S. export controls and trade sanctions programs, Ms. Bishop provides advice and assistance on the EAR, ITAR, and OFAC regulations, and reviews NISPOM and FOCI issues. She assists clients in determining the licensing requirements and controls applicable to various types of products, technology, and software at the State and Commerce Departments and assesses the applicability of various U.S. trade sanctions to a variety of activities and transactions. Ms. Bishop files classification requests, license applications, and disclosures where appropriate with the relevant administrative agencies. She also assists clients in investigations by agency enforcement personnel and the Department of Justice. Ms. Bishop has been involved in a number of trade remedy proceedings, including antidumping, countervailing duty, and Section 201 (Safeguard) investigations, as well as sunset reviews, scope inquiries, and anti-circumvention proceedings. Ms. Bishop has experience with companies in a wide range of industries, including auto parts, chemicals, consumer electronics, hand tools, industrial equipment, motor vehicles, and steel. She has participated in proceedings before U.S. Customs and Border Protection, the Bureau of Industry and Security, the International Trade Administration, the Directorate of Defense Trade Controls, the Office of Foreign Assets Controls, the U.S. International Trade Commission, the United States Trade Representative, and the U.S. Court of International Trade.
