Alan J. Lipkin is a partner in and founding member of the Business Reorganization and Restructuring Department of Willkie Farr & Gallagher LLP in New York. Mr. Lipkin specializes in bankruptcies and workouts.

Mr. Lipkin has represented, as lead counsel in both workouts and chapter 11 cases, the following debtors: 360networks, Frank’s Nursery and Crafts, Qualis Care, L.P., The Alert Centre, Inc. and ten related entities; and Episcopal Health Services Inc. and several related debtors. He has represented creditors’ committees or equity or bondholder groups in the Touch America, Aphton, United, Flooring America, Hagerstown, Great Lakes, Republic Health, TWA, and Calton, Inc. matters; indenture trustees in the AbitibiBowater, Nutritional Sourcing, and Pliant chapter 11 cases; and equity holders and/or members/major creditors in the Lehman, Brooklyn Hospital, United Hospital, Westchester Square Hospital, Spiegel, Eddie Bauer, Globalstar, and DirecTV Latin America chapter 11 cases. He has represented acquirors of major or substantially all of the debtor’s assets in chapter 11 cases such as 360networks in the GT Telecom, Corban, and Touch America chapter 11 cases and American Home Products, Inc. in its acquisition of A.H. Robins out of chapter 11. He also represented W.P. Carey in the Amerco (U-Haul) chapter 11 cases, in connection with providing $200 million of exit financing.

Selected Professional and Business Activities
Mr. Lipkin has lectured and authored articles on a number of business reorganization topics including real estate bankruptcies, representation of high-yield bondholders and equity committees, the application of fraudulent transfer statutes to leveraged buy-out transactions, and the bankruptcy laws of emerging growth countries. He has spoken at the Lavanthal & Horwath Real Estate Workout Conference on Bankruptcy and was a participant in conferences on Advanced Issues in Mergers & Acquisitions and U.S. Business Law for Canadians.

As a member of the Association of the Bar of the City of New York, Mr. Lipkin served on its 1997-99 Committee on Bankruptcy and Business Reorganization. He also previously served on the 1999 Southern District of New York Bankruptcy Court Survey Committee. He currently serves on the SDNY Bankruptcy Pro Bono Steering Committee.

Prior Experience
From 1978 to 1980, Mr. Lipkin served as law clerk to Chief Judge Almeric L. Christian, U.S. District Court for the Virgin Islands. Prior to joining Willkie, Mr. Lipkin was also involved extensively in chapter 11 cases, representing parties such as the secured bank lenders of Nucorp Energy, Inc. and the unsecured creditors’ committee for Kings Department Stores. He also represented clients in out-of-court debt restructurings, such as Frasse-Basset, Inc. and the insurance lenders of Ideal Basic Industries, Inc.
