• Representing an asbestos personal injury settlement trust in complex bankruptcy litigation concerning interpretation of the trust’s governing documents.
• Represented the seller of an industrial automation business in an earn-out dispute arising from obligations under a purchase agreement.
• Represented a leading financial services organization in earn-out litigation arising from its acquisition of a diversified investment management company.
• Representing a telecommunications company and its officers and directors in class action securities litigation arising from a $34 billion merger.
• Represented a leading retail and real estate holding company in connection with the restructuring of a department store chain and online retail subscription service.
• Secured acquittal on all counts for a shipbuilding executive charged with securities fraud, wire fraud, and money laundering arising from allegations of bribery to win large contracts in Mozambique in the closely followed case of United States v. Jean Boustani (E.D.N.Y.).
• Represented former partners of a private equity firm in confidential arbitration concerning interpretation of fund partnership agreements.
• Represented an investment firm in connection with an FTC and DOJ enforcement action and compliance obligations arising from a consent decree under the Hart-Scott-Rodino (HSR) Act.
• Represented a pharmaceutical company in the first jury trial under the Biologics Price Competition and Innovation Act (BPCIA), which resulted in a split decision on patent infringement, validity, and “patent safe harbor” issues.
• Represented a large accounting firm in successful appeal of a favorable jury verdict in case arising out of alleged misrepresentations in sports team financial statements.

Phil is a member of the New York State Bar Association, the American Bar Association (ABA), and the International Association of Privacy Professionals (IAPP). While in law school, Phil served as the Executive Articles Editor of the Columbia Law Review.

Phil previously served on the Board of Trustees of Adelphi University and the Adelphi University Alumni Advisory Council. In October 2020, Adelphi named Phil one of its 10 Under 10 Young Alumni for his exceptional career and professional accomplishments in the legal field.
