Partner Jacques-Philippe Gunther discussed how innovation impacts antitrust issues.

Jacques-Philippe Gunther spoke at the recent Séminaire Nasse, organized by the French Ministry of Economy and the French competition authority about “Antitrust & the Innovation,” examining how innovation can impact antitrust issues such as merger control, abuse of dominant position, standardization and state aids. His comprehensive presentation examined how the “innovation” argument has been used over the last ten years by competition authorities and courts both as a “defense” and offense argument.

These events, held three times a year at the French Finance Ministry, are named in memory of Philippe Nasse, the former vice president of France’s Conseil de la Concurrence (antitrust council), and feature an economist and a legal representative.
